Neuroharmony Clinic: Terms & Conditions

This Document Neuroharmony Clinic and its practitioners are committed to providing quality health services to our clients. The Terms and Conditions outlined in this document act as a contract between the business and its customers and clients, and apply whenever you access our products and / or services. We urge you to read them carefully to understand your obligations to the clinic, as well as our obligations to you.

Terminology Throughout this document, Neuroharmony Clinic and its staff are referred to collectively as ‘Neuroharmony Clinic’, ‘the business’, ‘the clinic’, ‘the staff’, ‘we’, ‘us’, or ‘our’; we identify Terms and Conditions as ‘T&C’; any customer and / or client accessing products and / or services supplied by the business (and therefore any person reading this document) will be referred to as ‘the client’, ‘the customer’, or ‘you’.

Our Responsibilities The staff at Neuroharmony Clinic value and uphold a high standard of clinical care for our clients. All business conducted at Neuroharmony Clinic abides by these T&C and our Privacy Policy. All our practitioners hold current professional indemnity and public liability insurance, as required under NSW law. Our staff recognise and work within their scope of practice, providing evidence-based therapeutic treatment, developed with reference to relevant and up-to-date scientific research. Clinical naturopaths and nutritionists are not considered medical practitioners or specialists, and thus cannot provide any medical diagnoses, treatments, or procedures for an illness or disease. Any recommendations, advice, guidance, information, or treatment provided to you by us should not take precedence over that of medical practitioners (such as a doctor, GP, or specialist).

Your Responsibilities To access our services, our expectations are that you will: a) Book appointments for dates and times that you will be available to attend; b) Communicate any concerns about attendance ahead of time; c) Provide a minimum of 24 hours’ notice if unable to attend the appointment; d) Be on time for your appointment, and able to stay for the duration; e) Complete all the required documentation to the best of your ability before attending your appointment (including intake forms that require Personal Information and / or Health Information that will be protected under our Privacy Policy). For your safety, you will need to provide thorough and accurate information about: i) Any known medical diagnoses, allergies, intolerances ii) Past or future hospitalisations or surgeries (including cosmetic procedures) iii) Your family health history (if known) iv) Medications you currently take, or have taken recently v) Supplements you currently take, or have taken recently vi) If you’re pregnant, breastfeeding, or trying to conceive vii) If you’re vegan, vegetarian, or practice religious or spiritual dietary practices (to avoid, for example, supplements containing animal products) f) Provide timely updates of the above information for the duration of treatment; g) Communicate any other information you consider pertinent or relevant; h) Treat all staff respectfully, and act in good faith; i) Comply with applicable laws, health and safety guidelines, and these T&C.

Suitability At Neuroharmony Clinic, we endeavour to improve access to health services for people of all abilities, genders, beliefs, sexual orientations, and cultural identities. While we make every possible effort to accommodate the specific needs of each client, we cannot guarantee that our services will be suitable for everyone. It’s our duty to ensure that both existing and prospective clients receive care that is appropriate, even if that means referring or making recommendations for treatment outside of Neuroharmony Clinic. This may occur when: a) An issue requires urgent or specialised medical attention; b) There are severe mental health concerns that require intervention; c) A practitioner believes they lack experience with a complex health issue; d) There is a conflict of interest or dual relationship present; e) Treatment interferes with religious beliefs, values, and practices; f) We are unable to obtain informed consent from a client; g) It would be unethical or immoral to pursue treatment for any reason; h) A client requests or demands a specific treatment we don’t offer.

Refusal of Service We reserve the right to suspend or discontinue access to our products and / or services if there’s failure to comply with applicable laws, health and safety guidelines, and these T&C.

Fees & Payments All fees set out on the website or communicated by our staff are applicable to our products and / or services, and are quoted in Australian dollars (AUD). Goods & Services Tax (GST) will be added to fees where applicable. We reserve the right to make changes to our fees from time to time, and will make reasonable attempts to communicate this with customers and / or clients. Payment terms vary depending on the products and / or services that you access. You hereby agree to pay for products and / or services in accordance with methods of payment communicated by our staff.

Cancellation, Rescheduling, and Refund Policy If you’re unable to attend an appointment, we require a minimum of 24 hours notice to cancel or reschedule without a fee. Cancellation or rescheduling within 24 hours of the booking time will incur a fee of 50% of the appointment. Failure to attend your appointment altogether, without notice, will incur a fee of 100% of the appointment cost.

If you arrive late to your appointment, we will do our best to accommodate you within the time that remains. The session will still end at the originally scheduled time and in most cases, cannot be extended. If you arrive more than 20 minutes late, we consider this a failure to attend, and the full fee (100% of the appointment cost) will apply.

Delivery of Products It is the responsibility of the customer and / or client to ensure that any products ordered from us can be received, for example, by ensuring a valid delivery address is provided, and that ordering, importing, and using products is allowed by law (if ordering outside Australia). You are responsible for all customs and import taxes and duties imposed on your orders. We are not responsible for any deliveries being misplaced or confiscated. Products directly from Neuroharmony Clinic are subject to availability, and a contract of sale is only formed once the order has been accepted. Orders placed with third-party suppliers, such as Vital.ly and NaturalScript, are subject to the business’ T&C – these orders are not the responsibility of Neuroharmony Clinic.

Informed Consent You have a right to make informed and voluntary decisions about your treatment in all healthcare settings. It’s our ethical and legal responsibility to ensure we act in accordance with the Australian Commission on Safety and Quality in Healthcare to ensure informed consent. Informed consent is "a persons’ decision, given voluntarily, to agree to a healthcare treatment, procedure, or other intervention that is made (1) following the provision of accurate and relevant information about the healthcare intervention and alternative options available; and (2) with adequate knowledge and understanding of the benefits and material risks of the proposed intervention relevant to the person who would be having the treatment, procedure, or other intervention". In order to obtain informed consent, we endeavour to provide you with clear explanations surrounding the nature of naturopathic care, and your individualised treatments. This also requires a thorough understanding of the risks, benefits, and expenses associated with the treatment. You are both allowed and encouraged to ask us questions at any time to clarify information we’ve communicated to you - this applies before, during, and after any of your appointments with us. Working with Children and Young People All our practitioners have completed their Working With Children Check (WWCC). We respect the autonomy and agency of children and young people, and put their safety and wellbeing above all else. The Children and Young Persons (Care And Protection) Act (1998) defines a child as being under 15 years of age, a young person as being 16 and 17 years of age, and an adult as being 18 years and over. The NHAA’s Code of Conduct (2021) states that “[if] a practitioner judges that a person is of sufficient age and of sufficient mental and emotional capacity to give consent to a service, then that person should be able to request and provide informed consent to receive services without the consent of a parent, guardian, or other legal representative”. Our practitioners assess each young person’s ability to provide informed consent based on their age, maturity, and understanding of the treatment, in alignment with the Gillick competence principle and Section 7.2 of the NHAA Code of Conduct. In most (but not all) cases, we will require the signature of a parent, guardian, or legal representative for clients under 16 years of age. The signature provided acts as acknowledgement, understanding, and agreement to the T&C from both parties. Medical Disclaimer Naturopathy is considered a Complementary or Alternative Medicine (‘CAM’), which is distinct from conventional medicine (i.e. ‘Western medicine’, ‘mainstream medicine’, or ‘modern medicine’). We prioritise the supportive, complementary, and integrative aspects of CAM at Neuroharmony Clinic by using evidence-based treatment designed as an adjunct (not an alternative) to conventional medical treatment. It is our belief that CAM treatments should not be utilised as substitutes or replacements for conventional medical treatments, as it’s outside our scope of practice. The recommendations, advice, guidance, information, and treatment provided to you by medical practitioners (such as a doctor, GP, or specialist) should be considered as the primary source of medical advice. Adapting treatment to support or complement conventional medical care is an intrinsic part of modern naturopathy. With your consent, we’re open to communicating and collaborating with any other practitioners responsible for your care, and urge you to discuss your choice to use naturopathic treatment with them. This is especially important where any medical treatments and medications are currently being used. We do not condone withholding any relevant or pertinent information surrounding your health or healthcare decisions from any practitioners. Doing so can pose significant risks to your personal health and safety. If you have concerns about a medical matter, you should consult with a qualified medical professional or healthcare provider as soon as possible. If you think you may be suffering from a medical condition, you should seek immediate medical attention. Do not delay in seeking medical advice, disregard medical advice, or discontinue medical treatment because of any recommendations, advice, guidance, information, and treatment provided to you by us. While you maintain the right to make decisions about how you approach your healthcare, it’s important to understand that decisions made following your appointment with us are made at your own discretion and risk. Neuroharmony Clinic and all current staff expressly disclaim all responsibility and liability for any loss, injury, damage, or claim arising in connection to any of the recommendations, advice, guidance, information, and treatment provided by us. Nothing in this disclaimer will limit or exclude any liability that may not be limited or excluded by applicable law. Dispute Resolution If you have any concerns arising out of your use of our products and / or services, we are open to communication with you to negotiate a solution or mutual understanding. We enter any discussion under the agreement that both parties will engage in an empathetic and respectful way that is productive and focused on a common goal of resolving the dispute. If we are unable to resolve the dispute this way, we ask that you contact the Naturopaths and Herbalists Association of Australia (NHAA) to lodge a complaint. Regardless of the outcome of a dispute, both parties agree to act respectfully by acting in good faith by, for example, refraining from publicly or privately defaming or disparaging the other party, or engaging with any conduct or communication that might negatively interfere with personal and / or professional interests of either party.

This agreement is subject to the governing laws of New South Wales. Regardless of where you reside, you irrevocably agree that if the dispute resolution processes fail, the courts of New South Wales, and the Commonwealth of Australia, will have exclusive jurisdiction.
